General terms and conditions of sale

Preliminary article

The conditions of sale and transport are deemed to be fully accepted by the customer during the validation of the order, whether for the customer himself or for a third party. They are tacitly and automatically transferable and applicable to the recipient of the service hereinafter referred to as "The passenger". When you place an order on behalf of others, you must ensure that they accept and comply with North East Balloon's (NEB) terms and conditions.
These General Terms and Conditions of Sale and Carriage are subject to French law and are applicable to all commercial relations between NEB and any customer or passenger. They also apply to free or reduced-fare transport.
All carriage is subject to the General Conditions in force on the day of departure. The carrier may modify these general conditions at its convenience, so it is up to the passenger, before departure, to regularly consult the general conditions posted on the https://www.north-east-balloon.fr/ website. They alone take into account any changes in international regulations (ICAO) that may have taken place during the validity of the ticket.

1 – The flight ticket

It constitutes a contract between the carrier, the customer and/or the passenger. It is nominative and must be presented at boarding, accompanied by an identity document. Any substitution of a passenger's name or any transfer of a ticket by its holder is prohibited. Any change cannot be made without the agreement of the carrier and requires the issuance of a new ticket, invoiced 15 euros. The ticket is not refundable, unless the "cancellation insurance" option was taken out at the time of purchase. In this case, only the price of the flight ticket can be refunded but the price of the "cancellation insurance" is never refunded.

Any operation relating to the ticket (extension, change of holder, refund, etc.) can only be done during the validity of the ticket. A ticket offered by North East Balloon is not subject to change.

2 – Validity of the ticket

The ticket is valid for 1 flight and can be used within 24 months from the date of issue. The validity can be extended free of charge by one year if your flight has been cancelled by NEB at least 4 times. If the booking file reveals a lower number, the extension of the ticket is possible for an amount of 50 €. Any ticket older than 2 years is expired.

3 – Rates

Prices are in Euros and changeable without notice. They include balloon flight, transport of passengers by vehicle to the flight sites, return after landing to the pick-up point, VAT (10%) and compulsory insurance.

4 – Payment

Full payment is required at the time of booking for individual customers (– 8 people). In the case of a group, a deposit of 30% of the total amount is required when booking. Fifteen days minimum before the date of the flight, the final number of people (nominative status) must be communicated to us with the payment of the balance. Tickets are issued and sent once payment has been made in full.

5 – Online payment

Our online payment formula is totally secure. This guarantee is offered to you by crédit coopératif via …………….. No one has access to customers' bank details. Payment data is transmitted confidentially and encrypted without going through our site.

6 – Booking of the flight date

The choice of the date of the flight can be made by phone or e-mail.

7 – Confirmation for the flight

The day before the flight, you must contact NEB by phone between 11:00 and 12:30 or between 14:00 and 15:00, in order to obtain the appointment time or the possible postponement in case of adverse weather forecasts.

8 – Cancellation by North East Balloon

NEB reserves the right to cancel a flight in view of weather forecasts that are not compatible with flight safety or if the number of passengers registered is insufficient. In these cases the ticket remains valid and another date is set.

9 – Cancellation by the Customer

It is possible to postpone your flight with a minimum notice of 96 hours before the booked date. If this deadline is not respected or in case of absence at the meeting place at the scheduled time and whatever the reason, the ticket is considered consumed and no refund will be made even if the cancellation insurance had been taken out.

10 – Cancellation by the pilot – Flight safety

Flights are carried out only in good weather conditions, weak wind, no precipitation or fog, no stormy conditions. The hot air balloon is an aircraft subject to the rules of the air, published by Civil Aviation, and the limitations of use published by the manufacturer and the operator. The pilot, captain, is required to respect them. For these reasons, he can decide to change the take-off site, cancel or interrupt the flight at any time. If the cancellation takes place before take-off, the ticket remains valid. Any flight beyond 30 minutes is considered completed. NEB cannot be held responsible for the various costs incurred following a cancellation (trips, hotel, meals). . .).

11 – Boarding conditions

Mobile phones must be turned off or in airplane mode. Cameras, cameras or phones used as such must be equipped with a safety strap. In order for passengers to enjoy maximum space and adopt a correct landing position, backpacks and handbags are not accepted on board. Heeled shoes are not accepted. A little fragile outfit and flat, sports or walking shoes are recommended.

12 – Insurance

The risks are covered for amounts comparable to those imposed by the Warsaw Convention of 1929 and in accordance with European Regulation 785/2004 which defines the insurance requirements applicable to aircraft operators. The insurance covers each passenger under the civil liability related to carriage for consideration for a ceiling in accordance with the regulations in force. Insurance for higher amounts can be taken out. Damage to objects, clothing, cameras, cameras…, internal or external prostheses are not taken into account.

13 – Medical fitness

The practice of hot air ballooning is accessible to anyone in good physical condition. Any serious medical problem remains confidential. Only a doctor is qualified to judge the suitability to perform a balloon flight. For safety, pregnant women cannot be accepted. Anyone who reveals a medical problem during boarding must present a certificate of fitness. Otherwise, it will not be admitted on board. The same shall be true for any person under the influence of narcotics or alcohol. In these two cases the ticket will be considered as consumed.

14 – Children

Are accepted in flight from the age of 6 years. Children under the age of 13 must be accompanied by an adult. If the child is not accompanied by his father or mother, he will have to prove a parental authorization. If the child does not have an identity document, the accompanying adult must provide a certificate certifying the age and identity of the child.

15 – Partnership

The service can be carried out in partnership with another company also approved by Civil Aviation for the air transport of passengers.

16 – Right of withdrawal

The provisions of Article L 121-18 of the Consumer Code do not apply in the context of passenger transport. NEB holds an air transport licence and an operating declaration (FR. DEC.559). The status of passenger air carrier exempts NEB from the provisions of the articles of the Hamon Law. The customer does not have the right of withdrawal.

17 – Right of access and rectification

The personal data concerning you are used to process your order and are essential for the realization of your flight. In accordance with the Data Protection Act of 6 January 1978, you have the right to access and rectify this data. When booking, the buyer must enter his telephone details, only used if necessary, to ensure the smooth running of the services. These data are not used for other purposes but the buyer is nevertheless informed that he can register free of charge with a body responsible for managing the list of opposition to telephone canvassing.

18 – Disputes
